1. Overview

This Privacy Policy explains how Dependable Equities LLC ("Developer", "we", "us" or "our") collects, uses, shares and protects personal information when you visit ownombelle.com (the "Site"), submit an inquiry, request information about Ombelle Fort Lauderdale, or otherwise interact with us.

It applies to visitors from anywhere in the world, and it describes the additional rights and choices we provide to individuals in the European Economic Area, the United Kingdom and Switzerland ("Europe") and to residents of the United States. Where a section is specific to a region, it is labelled as such.

We are the "controller" (Europe) and the "business" (California) responsible for the personal information described here. You can reach us at the details in section 16.

2. Information We Collect

Information you give us. When you complete the inquiry form on the Site (or the form in the pop-up window) we collect:

  • First and last name
  • Email address
  • Telephone number
  • The residence type you are interested in
  • Whether you are working with a real estate broker, and the broker or referral partner where applicable
  • How you heard about us (for example, an advertising campaign, an event or a referral)
  • Any message or additional detail you choose to include

Information we collect automatically. When you browse the Site we and our service providers automatically collect technical and usage information, including your IP address and approximate location derived from it, device and browser type, operating system, referring page, the pages and content you view, the date and time of your visit, and identifiers stored in cookies or similar technologies. See the Cookie Policy below.

Information from other sources. We may receive information about you from a broker or referral partner working with you, from a sales agent, from a marketing partner, or from a publicly available source, when it helps us answer your inquiry.

We do not ask for, and do not intend to collect, sensitive categories of personal information (such as health data, precise geolocation, or government identifiers) through the Site. Please do not include that kind of information in the message field of the form.

3. How We Use Information

We use personal information to:

  • Respond to your inquiry, contact you about Ombelle Fort Lauderdale and provide the information, brochures or pricing you request
  • Record your inquiry in our customer relationship management systems and share it with our sales team and the project’s licensed real estate brokers so that someone can follow up with you
  • Operate, maintain, secure and improve the Site, and understand how visitors use it
  • Measure and manage our advertising and marketing campaigns, including on third-party platforms, and understand which campaigns generate inquiries
  • Comply with our legal, regulatory, tax and record-keeping obligations, and enforce our rights
  • Prevent fraud, abuse and security incidents

We do not use automated decision-making that produces legal or similarly significant effects about you, and we do not use the Site to build a profile for the purpose of selling real estate securities.

5. How We Share Information

We do not sell your personal information for money. We share personal information with the following categories of recipients, and only as needed for the purposes described above:

  • Customer relationship management and lead routing. Inquiries are delivered to Follow Up Boss, the CRM used by the project’s sales team, and to the developer’s prospect-import system (Builder CMS), which routes the inquiry to the appropriate sales representatives and brokers.
  • Advertising, analytics and call-tracking providers. We use Google Tag Manager and Google Analytics, Google Ads and Floodlight, LinkedIn, Meta and CallRail, among others, to measure campaigns and, where permitted, to show advertising to people with similar interests. These providers may set cookies and receive identifiers and usage data. See the Cookie Policy below.
  • Service providers that host, maintain and secure the Site, and providers of email, forms and analytics that support the inquiry process, under contracts that limit their use of the data.
  • The project’s licensed real estate brokerage, the developers and marketing companies involved in the offering, and their personnel, so that your inquiry can be answered.
  • Professional advisers (law, accounting, insurance), and any party that acquires or is considering acquiring an interest in the project or in our business.
  • Authorities and third parties where we are required or permitted by law, to protect rights or safety, or to respond to lawful requests.

Where you are in Europe, our sharing for advertising purposes may be based on your consent, which you can withdraw through the cookie controls on the Site.

6. How Long We Keep Information

We keep inquiry records while we are in contact with you about the project and for as long afterwards as we need them for our legitimate business purposes, to serve you as a prospective purchaser, and to meet legal, tax and record-keeping obligations. When information is no longer needed, we delete it or irreversibly aggregate it. Cookies and similar identifiers are kept for the periods described in the Cookie Policy.

7. International Transfers

We are based in the United States and our service providers are located in the United States and in other countries. If you are in Europe, this means your personal information is transferred outside the European Economic Area. Where we transfer personal information out of Europe we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum and, where our providers are certified, the EU–US Data Privacy Framework. You can ask us for more information about the safeguards we use by contacting us as described in section 16.

8. Your Rights in Europe

If you are in the European Economic Area, the United Kingdom or Switzerland you have the right to:

  • Access the personal information we hold about you and receive a copy of it
  • Ask us to correct information that is inaccurate or incomplete
  • Ask us to erase information in the circumstances set out in the law, including where we no longer need it
  • Ask us to restrict or object to processing, including to processing based on our legitimate interests and to direct marketing
  • Receive information you gave us in a structured, commonly used format, and ask us to transmit it to another controller where technically feasible
  • Withdraw consent at any time, without affecting the lawfulness of processing carried out before you withdrew it
  • Lodge a complaint with your local supervisory authority. In the United Kingdom this is the Information Commissioner’s Office.

We will respond within one month, and we may extend that period where the law allows it. To exercise your rights, contact us as described in section 16. We may need to confirm your identity before acting on your request.

9. Your Rights in the United States

Residents of California and of other states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana and Florida) have rights over their personal information. Depending on your state, these may include the right to know what personal information we collect, use and disclose; to access and receive a copy; to correct inaccurate information; to delete information we collected from you; to opt out of the "sale" or "sharing" of personal information and of targeted advertising; to limit the use of sensitive personal information; to opt out of profiling with significant effects; and to not be discriminated against for exercising these rights.

California notice of sale and sharing. We do not sell personal information for monetary value. As is common on marketing websites, some of our advertising and analytics providers may receive identifiers and browsing information in a way that could be considered a "sale" or "sharing" for cross-context behavioral advertising under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. You can opt out at any time using the "Do Not Sell or Share My Personal Information" link in the cookie banner or the "Cookie preferences" link in the footer of the Site. We also honour the Global Privacy Control (GPC) browser signal as a valid opt-out request for the browser you use it with.

To exercise any of these rights, contact us as described in section 16, or use the cookie controls on the Site. You may use an authorised agent to submit a request on your behalf in California; we may ask for proof of authorisation and may still contact you to verify the request. We will confirm receipt within the period required by law and respond within the applicable statutory deadline. You may appeal a decision we make about your request by replying to our response.

We keep the categories of personal information described in section 2 for the business purposes described in section 3, for the retention periods described in section 6, and we disclose them to the categories of recipients described in section 5. We do not knowingly sell or share the personal information of consumers under 16 years of age.

10. Calls, Text Messages and Email

When you submit the inquiry form and provide your telephone number, you consent to be contacted by us, by the project’s sales team and by its licensed brokerage, including by telephone call and text message, at the number you provided, including through automated technology. Consent is not a condition of purchasing a residence.

You can opt out of text messages at any time by replying STOP, or ask for help by replying HELP. For calls in the United States, you may ask to be placed on our internal do-not-call list. You can opt out of marketing email by using the unsubscribe link in the message or by contacting us. We will still contact you when necessary to answer a request you have made or to administer a matter relating to your inquiry.

11. Security

We use administrative, technical and physical safeguards designed to protect personal information, including encrypted connections (HTTPS) to the Site and access controls on the systems that hold inquiry records. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send us confidential information through the Site.

12. Children

The Site is intended for adults interested in purchasing a residence, and it is not directed to children. We do not knowingly collect personal information from anyone under 18 years of age. If you believe a child has provided us with personal information, please contact us and we will delete it.

13. Third-Party Sites and Services

The Site links to third-party sites and services, such as our social media pages, the brochure and fact sheet documents, mapping providers and the brokerage’s systems. Those services have their own privacy policies, and we are not responsible for their practices. We encourage you to read the privacy notice of any service you use.

14. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices or in the law. We will post the updated version on this page and change the "Last updated" date above. Where the change is material, we will take additional steps to bring it to your attention where the law requires it.
